2. Data we collect
Depending on how you interact with us, we may collect:
- Identification and contact data, such as your name, email address and telephone number.
- Information supplied in the AERA5 application about your goals, current training situation, availability, readiness, commitment and investment readiness.
- Communications exchanged during the application and consultation process.
- Technical and browsing data necessary for security, operation and, where consent has been given, analytics or marketing.
The public AERA5 application is not designed to collect medical or health information. Please do not include medical details in open text fields.
3. Purposes and legal bases
AERA5 applications
We process application data to review suitability for the programme, communicate with the applicant, arrange a private consultation and take steps requested by the applicant before a possible service agreement. The legal basis is Article 6(1)(b) GDPR: steps taken at the data subject’s request before entering into a contract.
Application communications
We use contact details to respond to the application and manage the selection process. The legal basis is the same pre-contractual relationship and, where applicable, our legitimate interest in managing enquiries securely and efficiently.
Marketing communications
We will only send AERA5 news or programme updates when the separate optional marketing consent has been selected. The legal basis is Article 6(1)(a) GDPR. Consent may be withdrawn at any time without affecting previous lawful processing.
Website operation and security
Technical data may be processed to keep the website secure, prevent misuse and diagnose faults. The legal basis is our legitimate interest in operating a secure website.
4. Whether data is required
Fields marked as required are necessary to review an AERA5 application. If they are not completed, we may be unable to assess or respond to the application. Marketing consent is always optional and has no effect on the selection decision.
5. Recipients and service providers
Application data is accessible only to authorised members of OVERSEAS WELLNESS, S.L. who need it to review and manage the application. We do not sell personal data.
We may use carefully selected technical providers acting on our instructions, including our website and email hosting provider, Hostinger, and the WordPress and Elementor systems used to receive and store form submissions. These providers may access data only as necessary to deliver and secure their services and are subject to applicable data-protection obligations.
Data may also be disclosed when required by law, a competent authority or for the establishment, exercise or defence of legal claims.
6. International transfers
Where a technical provider or one of its authorised subprocessors processes data outside the European Economic Area, the transfer will be covered by an appropriate legal mechanism under the GDPR, such as an adequacy decision or the European Commission’s Standard Contractual Clauses.
7. Retention
- Applicants who are not accepted or do not proceed: application data will normally be retained for no longer than 12 months after the selection process closes, unless the applicant asks us to delete it sooner or a longer period is required to address a legal claim.
- Accepted applicants: relevant application data may become part of the client relationship and will be retained for the duration of that relationship and afterwards for the periods required by tax, accounting and other applicable laws.
- Marketing: contact data will be retained until consent is withdrawn or the communication purpose ends.
When data is no longer required, it will be deleted or securely restricted.
8. Selection and automated decisions
AERA5 applications are reviewed personally. We do not make acceptance decisions solely by automated means and the application does not create an obligation to accept an applicant or to make a payment.
9. Your rights
You may request access to your personal data, rectification of inaccurate data, erasure, restriction of processing, data portability where applicable, or object to processing based on legitimate interests. You may also withdraw marketing consent at any time.
To exercise these rights, email fit5albir@gmail.com and identify the right you wish to exercise. We may request reasonable proof of identity where necessary to protect your data.
You also have the right to lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos): www.aepd.es.
10. Security and confidentiality
We apply reasonable technical and organisational measures designed to protect personal data against unauthorised access, alteration, loss or disclosure. Access to AERA5 applications is limited to authorised administrators and communications are handled through controlled business systems.
11. Cookies and analytics
The website may use necessary cookies and, where applicable, analytics or marketing technologies subject to the choices presented in the cookie banner. Further information is available in the website’s Cookie Policy.
12. Changes to this policy
We may update this policy when the service, technology or legal requirements change. The current version and its update date will always be shown on this page.
